Booking Terms & Conditions – Splatter Painting Experiences

These Terms and Conditions ("Terms") apply to all Splatter Painting experiences, workshops and related services provided by Alma Tipon trading as Paperdoll Art Studio ("Paperdoll Art Studio", "the Studio", "we", "our" or "us").
By making a Booking, you confirm that you have read, understood and agree to be bound by these Terms. Where you make a Booking on behalf of other Participants, you confirm that you have the authority to accept these Terms on their behalf and agree to ensure that they comply with them.
1. Definitions
For the purposes of these Terms:
Booking means any reservation made for a class, workshop or experience operated by Paperdoll Art Studio.
Participant means every person attending a session, whether booked individually or as part of a group.
Lead Artist means the artist, instructor or member of staff responsible for delivering the session.
Artwork means any artwork created by a Participant during the session.
Gift Voucher means any Paperdoll Art Studio voucher purchased directly from the Studio.
2. Bookings & Payment
2.1
Full payment is required at the time of booking unless otherwise agreed in writing.
2.2
A Booking is confirmed only once payment has been successfully received and a booking confirmation has been issued by Paperdoll Art Studio.
2.3
It is your responsibility to check your booking confirmation carefully and notify us as soon as possible if any details are incorrect.
2.4
The person making the Booking is responsible for ensuring that all Participants:
meet the age requirements for the class booked;
are aware of these Terms;
comply with all instructions given by the Studio.
2.5
Paperdoll Art Studio reserves the right to refuse or cancel any Booking where incorrect information has been provided or where these Terms have not been complied with.
3. Cancellations & Rescheduling
3.1
Bookings may be cancelled or rescheduled up to 48 hours before the scheduled start time.
3.2
Requests received less than 48 hours before the scheduled session are non-refundable and cannot be rescheduled.
3.3
Failure to attend a booked session without prior notice will be treated as a No Show.
A No Show will result in the Booking being deemed used and no refund, credit or rescheduling will be available.
3.4
Any Booking that has been rescheduled must take place within the validity period of the original Booking or Gift Voucher.
3.5
Nothing in these Terms limits or affects your statutory rights under applicable consumer legislation.
4. Arrival
4.1
Participants should arrive approximately 10 minutes before the scheduled start time.
4.2
Sessions begin promptly.
4.3
Participants arriving more than 10 minutes late may be refused entry where their arrival would disrupt the session or affect the experience of other guests.
4.4
Paperdoll Art Studio reserves the right to commence a session without late arrivals.
4.5
Where entry is refused because of late arrival, no refund, credit or rescheduling will be offered.
5. Age Requirements
5.1 Public Splatter Classes
Public Splatter Painting Classes are strictly for Participants aged 18 years and over.
Children, babies and spectators under the age of 18 are not permitted to attend.
Participants who arrive with a child or baby will not be admitted.
5.2 Intro Splatter Classes
Participants aged 8–17 years may attend only when accompanied by a participating adult aged 18 years or over.
The accompanying adult must remain present throughout the session and is responsible for the child's supervision and behaviour.
5.3 Private & Family Sessions
Children aged 5 years and over may participate when accompanied by a responsible adult.
Children under the age of 5 years are not permitted to participate.
Parents and legal guardians remain responsible for the supervision, behaviour and welfare of children attending their Booking.
6. Health & Safety
6.1
Splatter painting is an active, creative and messy experience involving paint, movement and the use of shared studio equipment.
6.2
Participants are expected to take reasonable care for their own safety and the safety of others throughout the session.
6.3
All Participants must:
a. follow all instructions given by the Lead Artist or Studio Team;
b. use the protective equipment provided;
c. behave respectfully towards staff, other Participants and Studio property;
d. use paints, materials and equipment only for their intended purpose; and
e. immediately report any accident, injury, damaged equipment or safety concern to a member of staff.
6.4
If you have any medical condition, allergy, mobility issue or other circumstance that may affect your ability to participate safely, you should notify the Lead Artist before the session begins.
6.5
Paperdoll Art Studio reserves the right to refuse entry or end a Participant's involvement in a session without refund where, in our reasonable opinion, the Participant:
a. behaves in an unsafe, aggressive, abusive or disruptive manner;
b. appears to be under the influence of alcohol or drugs;
c. refuses to follow reasonable safety instructions;
d. deliberately misuses paint, materials or studio equipment; or
e. places themselves, another Participant or a member of staff at risk.
6.6
Any decision made under Clause 6.5 is final and is taken to protect the safety, wellbeing and enjoyment of all Participants.
7. Clothing & Personal Belongings
7.1
Splatter painting is intentionally messy and Participants should expect paint to come into contact with clothing, footwear and personal belongings.
7.2
Paperdoll Art Studio provides complimentary waterproof coveralls, gloves, protective eyewear and shoe covers to help minimise paint transfer.
7.3
Whilst reasonable care is taken, protective equipment cannot guarantee complete protection against paint transfer or staining.
7.4
Participants are responsible for wearing suitable clothing and footwear and should avoid bringing valuable items into the painting area.
7.5
Paperdoll Art Studio shall not be responsible for paint transfer or staining arising from the normal nature of the activity where reasonable care has been exercised and appropriate protective equipment has been provided.
8. Damage to Studio Property
8.1
Participants are expected to treat the Studio, its equipment and facilities with reasonable care.
8.2
Any deliberate, reckless or negligent damage caused to Studio property may result in the Participant being held responsible for the reasonable cost of repair or replacement.
8.3
Nothing in this clause limits Paperdoll Art Studio's right to recover any additional losses available under applicable law.
9. Artwork
9.1
Each Participant will create their own individual Artwork during the session.
9.2
Splatter painting is an expressive and experimental art form. As such, artistic results will vary and no particular outcome, style or finish can be guaranteed.
9.3
Participants remain the owner of the Artwork they create, subject to the collection provisions set out in these Terms.
10. Artwork Collection
10.1
Artwork normally requires approximately three (3) days to dry before collection.
10.2
Participants are responsible for arranging collection during the published collection times.
10.3
Artwork will be stored for up to fourteen (14) days after it becomes available for collection.
10.4
If additional storage time is required, Participants should contact Paperdoll Art Studio before the collection period expires. Any extension is entirely at the Studio's discretion and cannot be guaranteed.
10.5
Due to limited storage capacity, Artwork not collected within fourteen (14) days may be recycled, donated or disposed of without further notice or compensation.
11. Shipping
11.1
Shipping is available as an optional service for eligible Artwork.
11.2
Participants may alternatively arrange collection through their own courier.
11.3
Where a third-party courier is used, responsibility for the Artwork transfers to the courier once the Artwork has been collected from Paperdoll Art Studio.
11.4
Paperdoll Art Studio accepts no responsibility for delays, loss or damage occurring during transportation by third-party courier services.
11.5
Oversized Artwork may require specialist transportation and may not be suitable for standard courier services.
12. Photography & Video
12.1
Photographs and video recordings may occasionally be taken during sessions for use on the Paperdoll Art Studio website, social media channels and promotional materials.
12.2
Participants who do not wish to appear in photographs or video recordings should notify the Lead Artist before the session begins.
12.3
Paperdoll Art Studio will make every reasonable effort to respect such requests. However, where photography or filming takes place in a group environment, complete exclusion from incidental background images cannot always be guaranteed.
13. Studio Rights
13.1
Paperdoll Art Studio reserves the right to:
a. refuse or cancel a Booking;
b. refuse entry to any Participant;
c. remove a Participant from a session in accordance with these Terms;
d. substitute artists or instructors where reasonably necessary;
e. change studio rooms or layouts;
f. amend session formats, materials or class content where reasonably necessary; and
g. postpone, relocate or cancel a session where operational, health and safety or other unforeseen circumstances require.
13.2
Where Paperdoll Art Studio cancels a session, Participants will be offered an alternative date, studio credit or refund, as appropriate.
14. Events Beyond Our Reasonable Control
14.1
Paperdoll Art Studio shall not be liable for any delay, cancellation or failure to perform its obligations where such delay or failure results from events beyond its reasonable control.
14.2
Such events may include, but are not limited to, severe weather, flooding, fire, power failure, industrial action, government restrictions, public health emergencies, building closures, illness of key personnel or any other circumstance outside the reasonable control of Paperdoll Art Studio.
14.3
Where reasonably possible, an alternative Booking, studio credit or refund will be offered.
15. Gift Vouchers
15.1
Gift Vouchers are valid until the expiry date stated at the time of purchase.
15.2
Expired Gift Vouchers cannot be redeemed or extended unless required by applicable law.
15.3
Gift Vouchers are non-refundable, cannot be exchanged for cash and may not be resold without the prior written consent of Paperdoll Art Studio.
15.4
Bookings made using a Gift Voucher remain subject to these Terms & Conditions.
16. Privacy
16.1
Personal information collected during the booking process will be processed only for the purpose of administering Bookings, providing our services and communicating with Participants.
16.2
Paperdoll Art Studio processes personal data in accordance with its Privacy Policy and applicable UK data protection legislation.

18. Governing Law
18.1
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
18.2
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.3
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded under the laws of England and Wales.
